1. Agreement to Terms

By accessing our website or using Revival IV Hydration, LLC services (hereafter "Revival IV," "we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our services.

2. Medical Services & Limitations

2.1 Nature of Services

Revival IV provides mobile IV hydration and vitamin therapy services administered by licensed healthcare professionals. Our services are wellness-focused and are NOT a substitute for emergency medical care or ongoing treatment of medical conditions.

2.2 Not Medical Advice

Information provided on our website, in consultations, or through our assessment tools is for educational purposes only and does not constitute medical advice, diagnosis, or treatment recommendations. Always consult your primary healthcare provider before starting any wellness program.

2.3 No Guarantees of Results

While our services are designed to support wellness and hydration, individual results vary. We make NO GUARANTEES regarding specific outcomes, symptom relief, or health improvements. Results depend on many factors including your overall health, lifestyle, and individual physiology.

3. Eligibility & Contraindications

By booking our services, you represent that:

• You are at least 18 years of age, or have parental/guardian consent
• You have disclosed all relevant medical conditions, allergies, and medications
• You do not have contraindications including but not limited to: kidney disease, heart failure, uncontrolled high blood pressure, or severe allergies to treatment ingredients
• You are not currently pregnant or breastfeeding without physician clearance
• You understand that you are responsible for consulting your physician if you have any concerns

4. Assumption of Risk

You acknowledge and voluntarily assume all risks associated with IV therapy, including but not limited to:

• Bruising, soreness, or discomfort at injection site
• Allergic reactions or sensitivities to treatment ingredients
• Infection (though rare when proper protocols are followed)
• Electrolyte imbalances or adverse reactions
• Unexpected health complications related to pre-existing conditions

By proceeding with treatment, you acknowledge these risks and agree that Revival IV is not liable for adverse outcomes except in cases of gross negligence or willful misconduct.

5. Informed Consent

Before each treatment, you will be required to:

• Complete a health history questionnaire
• Disclose all current medications, supplements, and health conditions
• Review and sign a consent form acknowledging risks and benefits
• Ask questions and receive answers about the treatment

You have the right to refuse or discontinue treatment at any time.

6. Cancellation & Refund Policy

6.1 Cancellations

• 24+ hours notice: Full refund or rescheduling
• Less than 24 hours: 50% cancellation fee
• No-show: Full charge, no refund
• Emergency/Illness: Case-by-case consideration with documentation

6.2 Service Refunds

Once treatment has begun, no refunds are provided unless the service cannot be completed due to our error or failure. Refunds for incomplete services are prorated based on the portion of treatment received.

6.3 Dissatisfaction

Due to the nature of wellness services, we cannot offer refunds based on subjective dissatisfaction with results. However, we encourage you to contact us with any concerns and we will work to address them.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Revival IV's total liability for any claims arising from services shall not exceed the amount paid for the specific treatment session in question
• We are NOT liable for indirect, incidental, consequential, or punitive damages
• We are NOT liable for outcomes resulting from failure to disclose accurate health information
• We are NOT liable for complications arising from pre-existing conditions not disclosed to us

8. Indemnification

You agree to indemnify and hold harmless Revival IV Hydration, LLC, its officers, employees, contractors, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms of Service
• Your provision of false or misleading health information
• Your failure to follow pre- or post-treatment instructions
• Your violation of any applicable laws or regulations

9. Dispute Resolution & Arbitration

9.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at (573) 557-9066 to attempt informal resolution.

9.2 Binding Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Missouri.

9.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

10. Privacy & Data Protection

Your health information is protected in accordance with HIPAA and our Privacy Policy and HIPAA Notice. By using our services, you consent to the collection and use of your information as described in those documents.

11. Payment Terms

• Payment is due at the time of service unless other arrangements are made
• We accept cash, credit cards, and electronic payment
• Returned checks or failed payments will incur a $35 processing fee
• Insurance is generally not accepted; however, we can provide receipts for HSA/FSA reimbursement

12. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Revival IV Hydration, LLC or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without express written permission.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions.
